The Slovene civil ensign (Zastava trgovske mornarice Republike Slovenije, that is the flag for use on ships) is prescribed by regulation Pravilnik o izobešanju pomorske zastave in znamenj na ladjah trgovske mornarice Republike Slovenije (Regulations on hoisting the maritime flag and signals on ships of the merchant navy of the Republic of Slovenia), issued by the Minister of Transportation on 24 August 2001 and published in the Slovene official gazette Uradni list Republike slovenije 71/2001, 24 August 2001.
This regulation officially invalidates the previous relevant regulation, that of the Socialist Federative Republic of Yugoslavia from 1981, that was de facto obsolete for more than a decade.

Following the tradition on the eastern Adriatic coast, the civil ensign is prescribed to be in prpoprtions 2:3, with four sizes depending on the size of the ship:
- 2.5 x 3.75 m;
- 1.40 x 2.10 m;
- 0.80 x 1.20 m;
- 0.50 x 0.75 m.

Regulation Pravilnik o žolnih in plavajožih napravah (Rules on boats and floating devices), adopted on 30 April 2002 and published in the Slovene official gazette Uradni list Republike slovenije 45/2002, prescribes, among other things, the usage of flags on boats. Boats are defined as all vessels shorter than 24 meters. Article 24 of the Regulation prescribes the size of ensigns for boats used for "public purposes" (defined in Article 4 of the regulation as "navigation security, control and similar"), as:
- 50 cm x 100 cm;
- 35 cm x 70 cm;
- 25 cm x 50 cm.
That shall mean that the state ensign for boats is in proportions 1:2. Furtheron, these ensigns are allowed to be hoisted by any boat registered in Slovenia, when in Slovenian teritorial waters, and are mandatory when abroad. Therefore this is also the civil ensign for boats.

Following the practice of the Socialist Yugoslavia, which was also taken by Croatia, an administrative signal for the "vessels of the bodies responsible for the security of naval navigation" (that is, the police) (pravno znamenje plovila organov pristojnih za varnost morske plovidbe) is prescribed by regulation Pravilnik o izobešanju pomorske zastave in znamenj na ladjah trgovske mornarice Republike Slovenije (Regulations on hoisting the maritime flag and signals on ships of the merchant navy of the Republic of Slovenia), issued by the Minister of Transportation on 24 August 2001 and published in the Slovene official gazette Uradni list Republike slovenije 71/2001, 24 August 2001. The flag is square, blue with two white crossed anchors; the anchors should be included in an imaginary rectangle high 3/8 of the flag height and wide 1/3.

Article 25 of the aforementioned regulation prescribes the administrative signal, a blue square flag with two white crossed anchors, to be hoisted on bow of the boats belonging to the Maritime Administration (Uprava Republike Slovenije za pomorstvo).
